An appeal has been filed by Mr. Downs, who proposes to keep a recently constructed privacy fence, (constructed without a Land Use Permit), replacing a privacy fence.

Denial of this Land Use Permit is based on the Gerrish Township Zoning Ordinance; Section 20.15A3.  “Fences and walls up to seven (7) feet high that obstruct views and air flow by more than thirty percent (30%), including solid fences and walls, are permitted provided the fence is a minimum of ten (10)  feet from a lot line and does not project more than twenty five (25) feet from the dwelling”, Section 20.15A3
